Katy Gallagher announces she will seek preselection for Labor's ACT Senate ticket after being booted from the Upper House by the High Court over her dual citizenship.

Ousted senator Katy Gallagher will try to win back a seat in the Senate after losing her spot over British citizenship ties during the 2016 election.

When Ms Gallagher was ruled ineligible by the High Court in early May, Labor leaders like Bill Shorten and Penny Wong said she still had more to contribute, and Senator Wong doubled down today.

"I'm delighted that Katy Gallagher is seeking preselection to return to the Senate," she tweeted.

"Katy is a woman of great integrity and ability, and a key part of Labor's Senate leadership team."

She said on Facebook she had been weighing up her options over the past few weeks and, while this move was not entirely unexpected, said it "wasn't a straightforward decision".

"These reasons remain as relevant for me today as they did back then and so I have decided to put my hand up for preselection for the Senate in the next federal campaign."

The man who replaced Ms Gallagher on a recount, David Smith, has already signalled he had no plans to create a casual vacancy for her.

"I think the right thing to do would be to ensure that the decision of the High Court isn't perceived in any sort of way to be undermined," he told ABC Radio Canberra on the day of the ruling.

"Certainly, I would have no intention of stepping aside."
