A sergeant in the New South Wales Police Force is accused of using her rank to avoid a random breath test, later claiming it was a lesson in “the job etiquette”.

Sarah Johnston had been out with colleagues celebrating the start of 2016 at the Union Hotel and Rag & Famish Hotel in North Sydney when she decided she was going to drive home.

Minutes into her journey to the Central Coast the 50-year-old was stopped by other colleagues at a random breath test site on the Pacific Highway at Crows Nest.

The Crown told the jury that shortly after Constable Cameron Brooks said “okay sergeant, I’ll get you to count”, she drove her car forward to a more junior officer.

She allegedly told that probationary constable: “you’re not going to breath test me are you?”

“Yes, sergeant I am,” he replied.

“No, that would be a conflict of interest,” Johnston is accused of saying.

“Imagine if I blew over, which I won’t because I’m not, but imagine if I did the awkward situation it would put you in… do you get what I mean?”

He replied “okay sergeant” and Johnston drove away.

Later she is accused of sending a colleague text messages which read “declined and gave the pro a lesson on RBT and in the job etiquette” and “relieved I didn’t have that last beer.”

The Crown alleged she “she was concerned about was the risk and possibility of failing the test”.

The jury was told by refusing the RBT, she deflected the investigation into her blood alcohol level.

Johnston has pleaded not guilty to the allegation she intended to pervert the course of justice.

Her barrister Raymond Hood told the court while the conversation at the RBT site did take place “there are differences” which “will need to be examined particularly closely”.
